Sun seems to try to avoid talking about this issue in plain terms.  There was
a discussion on JavaLobby a few months ago where the CEO of Tower Technology
said that they had tried unsuccessfully for years to obtain the JCK to use in
connection with TowerJ, which used to be an independent implementation. 
They finally gave up on that idea and became a full Sun licensee in August.   

Unfortunately, it doesn't look like it's possible to search through older 
discussions on JavaLobby, or I would give you a reference for this comment.
